Representative Cases


  • Obtained judgment for landlord against directors of tenant non-profit corporation.  This case was fought to the Washington Supreme Court where David’s client prevailed – establishing significant new precedent in Washington regarding the economic loss rule.  David successfully collected attorney’s fees and costs from defendants. Eastwood v. Horse Harbor Foundation, Inc.,  170 Wash.2d 380, 241 P.3d 1256 (2010).
  • Successfully defended claim for breach of contract and specific performance arising from commercial purchase and sale agreement.  Was awarded, and collected, attorney’s fees and costs from plaintiffs. Evans v. Rauth, 138 Wash.App. 834, 158 P.3d 1261 (2007).
  • Successfully defended the City of Bremerton from civil rights claims at jury trial in federal court.  Defense verdict affirmed by the Ninth Circuit Court of Appeals. Lassiter v. City of Bremerton, 556 F.3d 1049 (C.A.9 (Wash.),2009).
  • Obtained summary judgment order dismissing claims against developer/seller of plat brought by buyer for fraud and breach of contract.
  • Successful foreclosure of mechanics lien for electrical subcontractor after a bench trial.  Was awarded, and collected, attorney’s fees and costs for client.
  • Successfully represented geotechnical engineer defending claims of professional negligence.   David’s client was released from liability without payment by him.
  • Represented owner of waterfront Bremerton condominium project in claims against developer for breach of contract and breach of fiduciary duty.  Obtained judgment.
  • Brought claim for prescriptive easement for a drain field by owner of mobile home park.  Obtained sought after easement by enforcing unwritten settlement agreement.
  • Successful defense of prescriptive easement/private condemnation claim.  Obtained summary judgment on most claims.  Plaintiff later dismissed remaining claims without payment or any other settlement from client.
